STANDARD TERMS AND CONDITIONS OF SALE

1. Definitions

In these Terms and Conditions:

  • "Seller" refers to Evolved Engraving LLC.
  • "Buyer" refers to the person or entity purchasing goods or services.
  • "Goods" means the products or services described in the order confirmation.

2. Orders & Acceptance

All orders are subject to acceptance by the Seller. A contract is formed only when the Seller issues a written confirmation or delivers the Goods.

3. Prices & Payment

  • Prices are stated in USD and exclude applicable taxes unless otherwise specified.
  • Payment for Ecommerce Goods are due at checkout.
  • Payment for Goods which are first accompanied by an approved quotation are due 15 days from the invoice date unless otherwise agreed in writing.
  • Late payments may incur interest at 4% per month.

4. Delivery

  • Delivery dates are estimates only. The Seller is not liable for delays beyond its reasonable control.
  • Risk of loss passes to the Buyer upon delivery.

5. Warranties & Returns

  • The Seller warrants that Goods will conform to the agreed specifications at the time of delivery.
  • Defective Goods must be reported within 20 days of receipt for repair, replacement, or refund at the Seller’s discretion.
  • All sales of Personalized items are final unless found defective due to craftmanship or other reasoning at the Seller's discretion.

6. Limitation of Liability

The Seller’s liability is limited to the purchase price of the Goods. The Seller is not liable for indirect, incidental, or consequential damages.

7. Force Majeure

The Seller is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, strikes, or supply chain disruptions.

8. Governing Law

These Terms are governed by the laws of Indiana, USA, and disputes will be resolved in the courts of St. Joseph County.

9. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy. By using our website services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms. Please be advised our website services are hosted in the United States. If you access our website services from any other region of the world with laws or other requirements governing personal data collection, use or disclosure that differ from applicable laws in the United States, then through your continued use of the services, you are transferring your data to the United states, and you expressly consent to have your data transferred to and processed in the United States.

10. Entire Agreement 

These Terms, together with the order confirmation, constitute the entire agreement between the parties and supersede all prior communications.
